Human Rights Advocates Make Clear Global Trend Towards Marriage Equality

ICAAD Submits Amicus Brief to U.S. Supreme Court

WASHINGTON DC, March 4, 2013 –
The International Center for Advocates Against Discrimination (ICAAD) brought together international advocates representing four continents to persuade the Supreme Court to find Proposition 8, the California ballot initiative that barred same-sex marriages, unconstitutional.
ICAAD filed its amicus (“friend of the court”) brief on March 28, 2013, in the case of Hollingsworth v. Perry, highlighting how both foreign and international law are rapidly evolving to recognize marriage equality as a basic right. Currently, both the United Kingdom and France have marriage equality legislation pending in parliament and are likely to become law as both countries have widespread support from their respective populations.

In building support for the brief, ICAAD brought together a group of international human rights advocacy organizations from the United Kingdom, Canada, South Africa, and Argentina. Marriage equality is a recognized right in the latter three countries. And soon, the Supreme Court will have to decide whether it will sustain the trend toward marriage equality by striking down discriminatory laws, or reverse the trend that members of the LGBT community and human rights advocates have fought for globally.“Sexual orientation discrimination and marriage equality are rapidly gaining global salience as more nations embrace the proposition that all consenting adults deserve an equal right to affirm their love through marriage. It is a matter of time before marriage equality becomes a universal norm, and we hope that the  Supreme Court will see the writing on the wall and seize the opportunity to exercise leadership in this important area of human rights” said Tejinder Singh, ICAAD Senior Advisor and counsel at Goldstein & Russell.

Mr. Singh went on to state, “If the Court finally determines that sexual orientation discrimination warrants heightened scrutiny, it will send a clear message to states, people, and the world that such discrimination violates our most cherished values. The brief filed by ICAAD and its partners puts these issues into stark relief.”

Jaspreet Singh, ICAAD Director of Policy & Advocacy stated, “Marriage equality is about equal rights, equal dignity, and removing laws that stigmatize and treat people as second class citizens.”
